Employment & Labour Relations
Every employment relationship is also a legal one, and fairness is the standard.
Labour law protects people at work and sets the rules for those who employ them. The conventions of the International Labour Organization are the common baseline, and each country writes its own law on top. South Africa has the Labour Relations Act, the Basic Conditions of Employment Act and the Employment Equity Act, with the CCMA and the Labour Court resolving disputes; the United Kingdom has the Employment Rights Act, and Kenya and Botswana each have an Employment Act.
Many disputes come down to process. A dismissal needs a fair reason and a fair procedure, and a good reason handled badly can still be found unfair. Warnings, disciplinary hearings, retrenchments and performance management all follow rules, and managers carry them out in practice. Consistent, documented, respectful handling prevents most disputes before they start.
This theme is about helping managers and HR teams understand the rights and duties on both sides, and handle difficult conversations fairly and lawfully.
